- Muthukumar subbukutty

Fraud ATM transaction with my atm card number, even ATM card was with us. How can I get money back?

Query: Brother in foreign is using axis bnk atm debit card. Got sms of withdrwl for 2 day in small amnts. Our card ws nt used still shwing our no in trnsction. 65000/- withdrwn. Complained in bnk but nt geting confident response. Wht are possible steps 2 recover money back.?

Answer:

Recently a large number of frauds had taken place and are also taking place in automated teller machines.
This is very simple.
You might have used the debit card somewhere - automated teller machine or point of sale terminal with a business unit
In the case of automated teller machine, the miscreants attach a small attachment with the card insertion slot and it can be rarely seen from outside; however while inserting the card, the cardholder can find some difference - some jerk or some difficulty in inserting the card. The attachment captures all the data from the cards inserted.
The miscreant takes back the device and he decodes the message through one card reading machine and he is able to get the entire details just like a bank ledger.
He picks up the cards where more number of funds are available and duplicate cards are generated and using these cards they withdraw the money.
Your card will be at Chennai and the amount will be withdrawn at Cairo or Canberra. How this takes place? Of course, the software data is sold to foreign clients and they generate cards and take out the money.
Recently RBI had come out with clear instructions that commercial banks should pay the money withdrawn fraudulantly from the automated teller machines within three days from the date of receipt of complaint from the customer.
You have to complain and you should complain providing all the details.
And you should send a letter now itself because for non submission of the complaints within the stipulated time means - you are accepting the transaction. Go to RBI website and read their instructions in this connection.
I am providing herewith a format of letter for your use and fill up the details and submit the letter in person or by registered post or by speedpost.

What is the procedure while the debit card has been fraudulantly used in automated teller machine?

Question: I am having a debit card pertaining to ABC bank and I wanted to withdraw cash using my debit card with one automated teller machine. I was not able to withdraw cash since the funds was found to be insufficient. I got one mini statement and I found that an amount has been withdrawn from an automated teller machine using my debit card. How to proceed in this case?

Answer:
You had not used your debit card for withdrawal from the automated teller machine. It means that some miscreants might have prepared a duplicate card for your debit card and might have withdrawn amount from the automated teller machine

You have to immediately lodge a complaint letter with your bank branch in this connection and you should furnish the details of your entire transactions in the letter. The bank should find out as to whether the withdrawal was through original debit card or a fake card.

The format of letter has been produced hereinbelow and you can make use of the card by furnishing the requisite details in the letter:

How the debit cards can be fraudulantly used?

01. You are having your debit card. Knowingly or unknowingly you had noted down the PIN number on the back side of the card in the white portion for easy remembrance. Now you had lost the card while on transit. Somebody takes the card and he goes to the nearest ATM and withdraws the maximum amount permitted for the day using the PIN number mentioned in the card. In this situation, immediately you have to contact the toll free number available in your bank automated teller machine and lodge a complaint and they will immediately black list the card. For the amount paid by the machine, you have to file separate FIR with the Police explaining the details about the loss of card.
02. You are going to get petrol for your vehicle and you are providing the debit card for payment of money. Apart from the handheld machine, without your knowledge, the delivery boy inserts the debit card in another machine which is a pin reader. Now the pin reader captures all details from the card and a duplicate debit card is prepared and the amount is withdrawn from the machine. In this case, you have nothing to do; however, on finding out the loss of money, you have to report to toll free number or your branch to blacklist the card.
The debit card and credit card users have certain responsibilities in protecting their cards and keeping secret the details about PIN number. This apart, the customer should not allow any other person to use his debit card and he should ensure that the debit card is utilised in his physical presence only

Which are called as financial intermediaries in the country?

Various ministries are functioning when it comes to Goverrnment of India; namely; Finance Ministry, Defence ministry, Home ministry etc.,

Finance ministry is headed by a minister for finance and the ministry deals with financial issues relating to the country and under finance ministry, there are several wings and economic affairs wing is one among such wings.

What are the different types of capital ?

When it comes to capital, it is the contribution by the owner in his business firm. It is called as the seed capital. It can be brought by the owner by his own sources or through funds mobilised from his friends, relatives and others.

In the case of companies which are incorporated as per Indian Companies act 1956 and for presently, the Indian Companies act, 2013, the capital can be classified as mentioned below:

Authorised capital:
Authorised capital is the capital as earmarked in the memorandum of association of the company for the purpose of mobilisation from the public in due course. This will not find a place in the balance sheet of the company.

Issued capital:
When the company is in need of funds, they are issuing some portion of the authorised capital for the public for subscription. When the shares are issued, the details are informed to the public by means of a prospectus and the prospectus contains the details of shares issued, the amount of each share available for subscription and the minimum subscription to be made by the investor

Subscribed capital:
It is the capital actually subscribed by the public. The issued capital and subscribed capital need not be the same. In the case of lesser subscription, the subscribed portion is found to be less than the issued capital

Paid up capital:
The paid up capital is the capital for which cash has been fully received by the company. Normally when are shares are issued, the investors are provided with option to pay the amount in several instalments namely - application money; allotment money; first call money and final call money etc.,
Sometimes, the entire money is received at the time of issue itself.

The paid up capital alone finds a place in the balance sheet since balance sheet provides the details of financial position of the firm.

Whether expenditure has anything to do with income tax payments?

Question:
I recently got a job opportunity at a private company in Pune where they are offering me a salary of Rs 12 lakhs per annum. I have investments totaling Rs 1 lakh annually. How much income tax would get deducted and would it get deducted on a monthly basis? Someone told me that since I have investments of Rs 1 lakhs, I would have to pay an income tax of 33% on 50,000 Rs, which is Rs.16,500 per month. Is that true? As I would be relocating to Pune from Mumbai, I would have other expenditures like rent and food. So can someone please explain how the income tax calculation would work?

Ans:
Your expenditure has nothing to do with income tax payments.
Income tax is related to your annual income subject to deduction of certain investments which are eligible for tax exemption.
Taking into consideration, that the investment of Rupees one lakh made by you is eligible for income tax rebate, I shall provide the following details
  • Total income - 1200000.00
  • Less investment eligible for tax exemption - 100000.00
  • Balance amount - 1100000.00
  • You are aged less than 60 years and for the first 250000.00 you need not pay income tax
  • Balance amount - 850000.00
  • Out of the above you have to pay income tax at ten percent for 250000.00 = 25000.00
  • The balance amount - 600000.00 and you have to pay 20 percent income tax for an amount of rupees 500000.00 = 100000.00
  • For the remaining amount of 100000.00 you have to pay thirty percent income tax - 30000.00
  • The total income tax payable = 25000 + 100000.00 + 30000 = 155000.00 and for this amount you have to pay educational cess at three percent of income tax = 4650
  • The total tax payable by you including educational cess is Rs. 159650.00 four annual income of rupees 1200000.00
